Why you cannot just cancel
The court is relying on the bond. The surety is on the hook to the court for the full amount, and your indemnity agreement is what backs the surety. Removing your signature while the defendant is out would leave the surety exposed with nothing behind it, so the contract does not allow it.
The mechanism that does exist
- Contact the bail agent and state plainly that you want the defendant surrendered and the bond released.
- Explain the reason — missed check-ins, a new arrest, threats, moving without notice, unpaid premium. Reasons matter for how quickly we act.
- The surety surrenders the defendant to custody under PC 1300, with the required paperwork filed with the court.
- The bond is released; your ongoing liability for the face amount ends.
Before you pull the trigger
- The defendant goes back into custody, and getting out again is harder and more expensive.
